Marc specialises in energy law, and energy and chemical projects. He represents energy and chemical companies, their shareholders and larger buyers. Marc is mainly involved in cases in which the production, transportation or supply of electricity, gas or heat, sustainable energy, energy subsidies and emissions trading play a key role. He also represents clients in court and arbitration proceedings concerning energy disputes, the drafting of energy, chemical and waste management contracts, and the identification of opportunities and risks in energy law, including the Dutch Electricity Act, Gas Act and Heating Supply Act.

Marc regularly publishes on energy law in the Nederlands Tijdschrift voor Energierecht journal. He teaches subjects relating to energy law, including in the context of ‘Energy on Location’, a postgraduate course at the University of Groningen. Marc is chair of Lex Mundi’s Energy and Natural Resources Group. He is a member of the Dutch Association for Energy Law. Before joining Houthoff, Marc worked as in-house counsel at DSM and Energy Beheer Nederland.

  • Houthoff advises Tofane Global on the acquisition of iBasis from KPN. Tofane Global, a new player in the telecom and digital services market, acquires KPN subsidiary iBasis. This acquisition is the first milestone in the intended strategy of the Paris-based company. By means of acquisitions and digital transitions, Tofane Global aims to become the market leader in worldwide telephone services. After the completion of the acquisition, Tofane Global and iBasis will continue to work with KPN as strategic partners.

  • Advised Attero in a dispute with RWE regarding a long-term landfill gas contract and in drafting new long-term gas sales agreements.
  • Water control board “Aa en Maas” is building a new biogas plant. For the operation the water control board will take residual heat from the municipal waste product centre. Moreover, the water control board will supply generated biogas to the nearby Heineken brewery. Houthoff is drafting and negotiating the agreements (including the PPA) and giving regulatory advice.
  • Houthoff advised European Merchant Finance, a new Dutch alternative finance provider, on the structuring of its new and bespoke SME finance concept and the finance documentation tailored for that purpose.
  • Advising European Merchant Finance, a Dutch trade finance company, on payment services and credit compliance aspects as well as its contract with CCV Holland, a Dutch regulated payment institution.
  • Advised Huntsman on the amendment of several major site energy and utilities contracts with Eurogen/Air Liquide.
  • Houthoff is advising the Province of Zeeland, one of the public shareholders of Delta N.V., on the restructuring and split of Delta N.V., including its nuclear, wholesale, retail and grid operating businesses.
