Hans-Jan van Kralingen received his Ph.D.

On Wednesday 26 February, Hans-Jan van Kralingen received his Ph.D. from Leiden University. His dissertation was titled ‘The indivisibility of the right of pledge and mortgage; deconstruction of a tenet’. His Ph.D. supervisors were Prof. W.J. Zwalve and Prof. E. Koops. Prof. Mariëlle Koppenol-Laforce was a member of the reading committee.

Article 230 of Book 3 of the Dutch Civil Code states that the right of pledge and mortgage is indivisible, but it does not explain what that means. That is why in the literature, various, sometimes conflicting, rules are deduced from the indivisibility of the right of pledge and mortgage. By means of a study in the field of legal history, Hans-Jan researched what the indivisibility initially entailed. Based on this he drew some conclusions for the meaning of the tenet in current Dutch law. In short, the indivisibility of the right of pledge and mortgage means that, if the parties have not agreed otherwise, the entire collateral serves as security for every part of the insured debt.

Hans-Jan is a member of the Public Law, Investigations & Corporate Crime Team. Several of his colleagues were present at the doctoral thesis defence ceremony.
