Dutch Act on the security screening of investments, mergers and acquisitions (Vifo Act) against the background of European legislation
2 February 2023

The Netherlands is considered worldwide as an attractive country for foreign companies to invest in.  A general prior screening for foreign investments will soon be introduced in the Netherlands: the Act on the security screening of investments, mergers and acquisitions (Wet veiligheidstoets investeringen, fusies en overnames, also called the Vifo Act).

This Act cannot be dissociated from the EU Regulation establishing a framework for the screening of foreign direct investments (FDI regulation).

Gerrit Oosterhuis and Olga Korneeva discuss this new Act and the FDI regulation in the Dutch Journal for European Law (Tijdschrift voor Europees Recht). Read the full article here (in Dutch only).
