Berend specialises in Dutch and EU competition law, with a particular focus on healthcare, energy and online markets. His areas of expertise include merger control procedures and cartel and dominance cases, and he represents clients in both civil and administrative proceedings. Berend studied both Economics (2004) and Law (2006) at the University of Groningen. Given his economic background, Berend’s approach is characterised by the use of both legal and economic analysis to achieve optimal solutions and litigation strategies.

Berend frequently publishes on different aspects of competition law and is editor of the reference books European Competition Law (Edward Elgar) and Nederlands Mededingingsrecht (Kluwer). Berend is a member of the Dutch Association of Competition Law and the Dutch Association of Health Law.

  • Houthoff assisted the AMC and VUmc hospitals in obtaining the required approval from the Netherlands Authority for Consumers & Markets (ACM) for an administrative merger. The approval enables the two Amsterdam-based university medical centres to cooperate on patient care, research, education and training without limitation. This will create the biggest university medical centre in the Netherlands.
  • Representing the association of realtors VBO Makelaar in civil proceedings before the court of Amsterdam against Funda, the dominant online real estate portal in the Netherlands and subsidiary of the largest association of realtors in the Netherlands, NVM. The case is one of the few Dutch cases based on abuse of dominance. The abuse consists of discriminatory practices by Funda to the detriment of VBO's members.
  • Houthoff advised Media Markt – Saturn on the establishment of a joint venture with Talpa, Juke Nederland B.V. Juke has launched an online on-demand music streaming service offering unlimited access to songs, playlists and radio content.
  • Representing an undertaking in proceedings before the ACM regarding an alleged cover pricing cartel in the construction sector.
  • Assisted the two Amsterdam university hospitals, AMC and VUmc, in obtaining regulatory approval for their anticipated merger from the Dutch health care authority, NZa. The NZa granted its approval on July 14. Following this approval from the NZa, the university hospitals will notify their intended transaction to the Dutch competition authority ACM.
