Workshop MiCAR licence application and notification procedure

The crypto market is developing fast. As bitcoin is gaining popularity among institutional investors, the European Union is trying to get a grip on crypto-asset service providers (CASPs) by introducing the Markets in Crypto-Assets Regulation (MiCAR). From 30 December 2024, CASPs will require a MiCAR licence to operate in the Dutch and EU markets. Specifically, this means that market participants should act now to prevent having to suspend or discontinue their services. This could also apply to parties that are not subject to today's registration regime under the Money Laundering and Terrorist Financing (Prevention) Act (Wet ter voorkoming van witwassen en financieren van terrorisme). 

During the workshop, we will go through the licence application process. We will keep matters simple, focusing on questions in the market. How should you apply for a licence? What requirements must the organisation meet? And how can you ensure that the Dutch Authority for the Financial Markets (AFM) will ultimately grant a licence as quickly as possible? We will also discuss the screening of CASP directors. What does this screening entail, and when does the AFM consider a director 'suitable'? Finally, we will focus on the obligation for shareholders to request a declaration of no objection from the Dutch Central Bank (DNB).
