
WEBINAR ON RECENT DEVELOPMENTS REGARDING THE UNFAIR TRADING PRACTICES (AGRICULTURAL AND FOOD SUPPLY CHAIN) ACT
The Unfair Trading Practices (Agricultural and Food Supply Chain) Act (Wet oneerlijke handelspraktijken landbouw- en voedselvoorzieningsketen, hereinafter: the UTP (Agriculture) Act) protects producers against large buyers' abuse of procurement power. The Act took effect on 1 November 2021 and is enforced by the Netherlands Authority for Consumers and Markets (ACM). Individual disputes can be submitted to a complaints board under this Act. This year saw the first precedents
ACM applied the UTP (Agriculture) Act in three cases: two in the dairy sector and one in the pig farming sector. The complaints board also gave a decision in a dairy sector case. These cases provide a first glimpse into ACM's and the complaints board's application practices under the UTP (Agriculture) Act.
On 26 November, Houthoff will host a webinar in which Yvo de Vries, Gerrit Oosterhuis and Greetje van Heezik will discuss these recent developments and their impact on the field. They will also zoom in on practices in other EU Member States, where regulators primarily target buyers in the retail sector. This will provide insight into how Dutch practices compare to those in other European countries.
