Privay Data Protection

Privacy and Data Protection

Every organisation processes personal data, like information on employees or customers. The Internet of Things and the increasing use of cloud services, as well as growing globalisation, means that it has become a challenge to process personal data in a way that is secure and complies with privacy laws.

Houthoff's Privacy & Data Protection Team has extensive experience in advising and assisting clients on adapting their corporate policy to comply with EU and Dutch privacy laws, including the General Data Protection Regulation. They regularly perform privacy audits for clients. Our privacy specialists advise clients on areas such as the privacy aspects of insourcing and outsourcing business activities, the notification of data breaches, the performance of data analyses (big data), data protection impact assessments (DPIAs), central HR databases, storage periods, whistleblower schemes, processing agreements, employee codes of conduct for email and the internet, and the transfer of data to the United States and other countries outside the EEA in the context of these activities.

Our Privacy & Data Protection Team has gained specific expertise within a number of sectors, including e-commerce, FinTech, the automotive industry, finance and retail.

Our expertise on privacy

Organisations that process data have to meet complex EU and Dutch privacy laws (which will soon include the General Data Protection Regulation). To be able to assess whether a client’s company policies meet these requirements, our Privacy & Data Protection Team has developed a privacy compliance audit that they use to provide clients with efficient and thorough advice.

Our clients are often pioneers within the technology sector. They engage our privacy specialists for matters relating to connected cars, mobile payments, the Internet of Things, e-commerce, FinTech, big data and online cloud solutions.

Personal data may only be transferred to countries outside the EEC under certain conditions. Our firm assists clients with this; for example, when data needs to be transferred to the United States in the context of a discovery investigation.

A data breach can bring a company to its knees and cause considerable reputational damage. Clients recognise our extensive expertise in this area, from drafting a clear data breach protocol and notifying the Dutch Data Protection Authority of a data breach to informing the parties affected.

Our experienced Privacy & Data Protection Team works with our experts on areas such as IT, employment law and M&A. This multi-disciplinary approach enables Houthoff to deliver well-thought-out solutions, and our specialists to help clients succeed.
