Karien van Boekel and Joost den Hollander contribute to ‘Surseance van betaling’

While the WHOA has attracted significant attention in recent years, surseance van betaling remains a relevant and important instrument within Dutch restructuring law. In the recently published book Surseance van betaling, Karien van Boekel and Joost den Hollander authored two chapters on the formation of a composition agreement, its court confirmation and its legal consequences for the parties involved.

The book, edited by Karen Harmsen and Alice van der Schee, builds on the seminal work of A.L. Leuftink published in 1995. Contributions from various specialists in the field address topics such as the role of creditors and administrators, the criteria for court confirmation and the legal effects of a confirmed composition agreement.

Houthoff is closely involved in the development of this area of law and has, in recent years, acted in various capacities in several landmark surseance van betaling proceedings, including those of Steinhoff and DSB N.V. Through this publication, Karien and Joost contribute to the further development of legal scholarship in a field that continues to evolve, not least under the influence of European legislation.
