Houthoff’s IP Team advises national and international clients in all intellectual property areas, including copyright, trademarks, design rights, trade name rights, domain names, database rights and patents. We are also one of the few firms that specialise in plant breeders’ rights. Our IP Team also advises clients on the protection of trade secrets.

Our IP specialists assist clients in complex IP cases and have extensive experience in litigating before the Dutch Supreme Court and the European Court of Justice. They represent pharmaceutical companies in patent disputes and are also sparring partners for tech start-ups. They give clients from Houthoff’s market-leading automotive practice group advice on a wide range of IP matters. The IP Team is often involved in M&A and technology-related transactions, in which they work closely together with our experts in other areas.

work

Represented Omnis Power OÜ in preliminary injunction proceedings against Omnis Power GmbH in a trademark infringement dispute relating to counterfeit solar panels, that included several third-party attachments.

Represented the RDW, the holder of the Dutch vehicle registration register, in patent invalidity proceedings at the Dutch Court of The Hague.

Advised Dutch National Opera & Ballet, one of the world’s foremost opera and ballet companies, on all its copyright, licensing and music rights matters.

Represented classified advertisement platform Marktplaats, seeking the transfer of the domain names 'marktplaatsnederland.nl' and 'marktplaatsbelgië'. The disputed domain names were used to operate a scam by redirecting Internet users to third-party websites and fake advertisements.

Advised the ad hoc group of secured lenders to Tupperware Brands Corporation in connection with the Chapter 11 case of Tupperware Brands and its subsidiaries filed in Wilmington, Delaware. Houthoff advised the ad hoc group, among other things, in connection with the Dutch law aspects of the acquisition and of global rights to the Tupperware brand, intellectual property and operations in key markets pursuant to a sale authorized under section 363 by the Delaware Bankruptcy Court.

Represented RDW (Vehicle Licensing Authority) before the Council of State (highest administrative court) in proceedings brought by a group of data subjects alleging violations of the GDPR by RDW pertaining to automated decision-making.

Lodged a B2B complaint with the Dutch Advertising Code Committee (RCC) on behalf of Marktplaats (a classified advertising site based in the Netherlands) against Pakkie (a payment and delivery service company).

Advised Dutch National Opera & Ballet, one of the world’s foremost opera and ballet companies, on all its copyright, licensing and music rights matters.

Assisted Bosch Rexroth in the divestment of a part of the Bosch Rexroth business. The project was extraordinary complex because of the complex carve-out, including not in-scope entities and the integration of the divesting businesses with the remaining business, all having substantial IP / Technology portfolios.

Advises Lumileds International on a definitive agreement under which San’an Optoelectronics and Inari Amertron Berhad will acquire Lumileds Holding B.V. and its European and Asian subsidiaries.

Advised Ali M. Barwani Investment Co (BVI) on the sale and transfer of Oceanco, universally recognised for designing and constructing bespoke super-yachts that redefine the limits of naval architecture, to an American technology entrepreneur.

Advises Oceanco, universally recognised for designing and constructing bespoke super-yachts, on the intended acquisition of Alewijnse, a highly renowned provider of tailored electrical and automation solutions.
