Paul specialises in complex cross-border disputes. His practice includes international mass claims (class actions under the Dutch WAMCA), competition law follow-on litigation, cross-border debt collection and asset tracing. Paul excels at determining international strategies in matters where several possible courts may have jurisdiction and foreign parallel proceedings are already pending. In this context, he advises on jurisdiction motions, cross-border discovery, attachment of assets, the invocation of arbitration clauses and the enforcement of foreign judgments. Paul has successfully represented various large companies and conglomerates in Dutch courts, often in multiparty disputes requiring smooth cooperation with other counsel. Houthoff’s Corporate/M&A, Finance, and Restructuring & Insolvency teams also consult Paul for private international law advice in transactions.

Paul has been teaching private international law courses for the judiciary and the Grotius Academy. He regularly teaches guest lectures at Utrecht University and Tilburg University. Paul publishes on civil procedural law and private international law. Between 2007 and 2011, he finished his Ph.D. research at Tilburg University. Paul is an active member of the International Bar Association (IBA), the American Bar Association (ABA), the International Association of Young Lawyers (AIJA) and the Dutch Association for Procedural Law.

  • Represented Fortenova Group, the largest food producer and retailer in South-Eastern Europe with an annual turnover of EUR 5 billion and 47.500 employees, in the implementation of a comprehensive restructuring resulting from the presence of sanctioned debt and equity holders in its capital structure and cross-border litigation in connection therewith.
  • Advised an ad hoc group of secured lenders to Tupperware Brands Corporation who successfully completed the acquisition of certain key assets of the Tupperware Group, including global rights to the Tupperware brand name and related intellectual property as well as operations in core geographic markets.
  • Represented LG Electronics succesfully in a competition damages case about cathode ray tubes (CRT). The multi-billion claim was brought before the Dutch civil courts by a Turkish television manufacturer in 2014. The claimant initiated parallel proceedings against the same parties in Turkey, resulting in a final judgment in which was held that the claim was inadmissible against the defendant CRT manufacturers. LG Electronics and its co-defendants successfully argued that the Dutch court should recognise that final Turkish judgment. Accordingly, the Oost-Brabant District Court declared the claims against LG Electronics, Samsung SDI and Technicolor inadmissible.
  • Ph.D. Civil Procedural Law (Tilburg University) (thesis title: “Sturen met proceskosten. Wie betaalt de prijs van verstorend procesgedrag?” (“Instrumental Cost Shifting: Who Pays the Price for Disruptive Conduct During Proceedings?”)
  • LL.M. Research Master’s Degree in Law (cum laude) (Tilburg University)
  • Admitted to the Bar in the Netherlands in 2012

Litigation
Business disputes can have a major impact on your organisation's reputation, continuity and financial position. Conflicts are becoming increasingly common due to growing regulation and social pressure. Shareholder disputes, contractual conflicts, directors' liability and collective actions invariably call for a well thought-out strategy and a thorough understanding of the sector.
Competition Litigation / Private Enforcement
Damages claims resulting from violations of EU and national competition law play an increasingly prominent role in the context of company liability.
Class Actions
Companies, financial institutions and governmental bodies increasingly find themselves confronted with mass claims in the Netherlands, often initiated by well-funded claim vehicles. Over the past decade, the Dutch jurisdiction has emerged as a popular hub for such claims.
ESG & Sustainability
Behind the daily headlines on sustainability and environmental, social and governance (ESG) issues hide complex challenges such as permitting, subsidies, funding and reporting obligations. These matters affect the expectations and demands of all corporate stakeholders.
