Procedure – Physical environment plan

Physical environment plan

From 1 January 2024, every municipality has one environmental plan that applies to its entire territory and that contains all municipal rules on the physical living environment. In due course, this environmental plan will replace all zoning plans and many municipal bylaws. It also contains rules on water and the environment, for example, which were formerly regulated at national level. This makes the environmental plan the main regulatory framework for municipalities themselves as well as for their residents and businesses. An environmental plan does not take effect until a procedure for its adoption has been completed. This procedure is the only opportunity for making any substantive changes to the environmental plan.

Our Procedure – Environmental plan factsheet therefore discusses this procedure and explains the stages at which this procedure offers the possibility to make any substantive changes – through public participation or through the administrative court. In addition to the factsheet, we have also included a procedure timeline, showing the various stages of the procedure for drawing up or changing an environmental plan.

Environment & Planning
In a place as densely populated as the Netherlands, it is common to see small areas of land with many different functions and uses. Environmental law regulates the complex distribution of available space. This area of law is constantly changing due to new national and European laws and regulations, new building techniques and societal developments.
Environment & Planning Act
The Environment Act covers the space in which people live, work and relax. This new law merges old laws and contains rules for what can be seen, heard and smelled outside.
